APPLICANT REQUESTS THAT:
His record be corrected to reflect his awarded Legion of Merit,
with the First and Second Oak Leaf Clusters (LOM, w/1st and
2nd OLCs).

STATEMENT OF FACTS:
A similar appeal was considered and denied by the Board on
28 Apr 11. In his initial request, the applicants record was
administratively corrected to reflect his entitlement to the LOM
and the Berlin Airlift Device (BAD). For an accounting of the
facts and circumstances surrounding the applicants request,
and, the rationale of the earlier decision by the Board, see the
Record of Proceedings at Exhibit F.
The applicant submits a request for reconsideration, contending
that his record should be corrected to reflect his entitlement
to his awarded decoration.
In support of his appeal, the applicant provides a personal
statement and a copy of the award elements for the LOM, 1st OLC.
The applicants complete submission, with attachments is at
Exhibit G.

THE BOARD CONCLUDES THAT:
Sufficient relevant evidence has been presented to demonstrate
the existence of error or injustice warranting partial relief.
In an earlier finding, the Board found insufficient evidence of
an error or injustice; nonetheless, the applicant provides a
copy of the award elements and based on a review of the evidence
presented, it appears the applicant was, in fact, awarded the
Legion of Merit, with One Oak Leaf Cluster. We have attached a
copy of the special order awarding the additional LOM.
Notwithstanding, the above, other than his own statements, the
applicant has not provided any evidence to substantiate his
entitlement to the LOM, w/2OLCs. Therefore, in view of the
above, we recommend the applicants record be corrected to the
extent indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air
Force relating to APPLICANT, be corrected to show that:
a. His DD Form 214, Report of Separation from Active Duty,
issued 28 February 1974, Item 26, Decorations, Medal, Badges,
Commendations, Citations and Campaign Ribbons Awarded or
Authorized be amended to reflect award of the Legion of Merit,
with One Oak Leaf Cluster.
b. That the award element, including the certificate, the
accompanying citation, and Special Order GB-611, issued on
3 September 1971, be placed in his official record.
